Terms of Service

1. The service

Mushroom Identifier is a website-based tool that lets users upload one or more photos of mushrooms or fungi and optionally provide notes, a date found, or a location in order to receive an AI-generated identification result.

Mushroom Identifier is provided for informational and educational purposes only.

By accessing or using Mushroom Identifier, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

Mushroom Identifier is intended only for adults aged 18 or older.

By using the service, you represent and warrant that:

  • you are at least 18 years old
  • you have the legal capacity to agree to these Terms
  • you will use the service only in compliance with applicable law and these Terms

If you are under 18, you may not use the service.

3. No account required

Mushroom Identifier currently does not require user accounts for the core identification service.

Because the service is designed for one-off, browser-based use, we may not be able to preserve access to past uploads, results, or requests after processing is complete.

4. Permitted use

You may use Mushroom Identifier only for lawful, personal, educational, informational, or other legitimate purposes consistent with these Terms.

You agree not to:

  • use the service for any unlawful, fraudulent, abusive, or harmful purpose
  • upload content you do not have the right to submit
  • upload content that infringes intellectual property, privacy, publicity, or other rights
  • submit malware, malicious code, or harmful files
  • interfere with, disrupt, probe, overload, or attempt to bypass any security or rate limits on the service
  • use bots, scripts, scraping tools, or automated methods to access the service in an unauthorized or excessive manner
  • attempt to reverse engineer, extract source code from, or copy the service except where prohibited by law from restricting that activity
  • use the service to develop, benchmark, or improve a competing product in a manner that violates applicable law or our rights
  • use the service in any way that could damage, disable, or impair the service or other users' access to it

We may set or enforce technical limits on use, including limits on request size, number of uploads, or request frequency.

5. Your submissions

You may submit:

  • photos
  • optional notes
  • an optional date found
  • an optional location

Photos are required for identification. Notes, date found, and location are optional.

You must ensure that anything you submit:

  • is accurate to the best of your knowledge
  • does not violate any law or third-party rights
  • does not include sensitive, confidential, or highly personal information unless you are willing to accept the risks described in our Privacy Policy

You should keep uploads focused on the mushroom or fungus you want identified and avoid including unnecessary personal information.

6. Ownership of your content

You retain ownership of the photos, notes, date found, location, and other content you submit ("User Content").

However, by submitting User Content through Mushroom Identifier, you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, modify, and use that User Content only as reasonably necessary to:

  • operate the service
  • process your request
  • generate results
  • maintain, secure, monitor, debug, and improve the service
  • enforce these Terms
  • comply with legal obligations

This includes sending submitted content to our hosting, storage, analytics, security, and AI/model service providers as described in our Privacy Policy.

You represent and warrant that you have all rights necessary to submit the User Content and to grant the license above.

7. AI-generated results

Mushroom Identifier uses third-party AI and model providers, including OpenAI and Google, to help generate identification results.

Results may be inaccurate, incomplete, inconsistent, outdated, or inappropriate for your needs. Different photos or prompts may produce different results.

You acknowledge and agree that:

  • identification results are generated automatically
  • results are provided on an as is and as available basis
  • you are solely responsible for reviewing and evaluating any output before relying on it

8. Safety Disclaimer

Mushroom Identifier does not provide professional advice.

The service is not a substitute for professional mycological, toxicological, medical, poison-control, laboratory, safety, legal, regulatory, or foraging advice.

You must not rely on Mushroom Identifier for decisions involving:

  • whether any mushroom or fungus is edible, non-toxic, or safe
  • whether something is safe to touch, handle, collect, prepare, cook, consume, feed to animals, sell, serve, or share
  • suspected poisoning, allergic reactions, illness, symptoms, or emergency situations
  • harvesting, foraging, land access, protected species, or local regulations
  • commercial sale, restaurant service, food preparation, or public distribution
  • legal, regulatory, permitting, or compliance decisions
  • any situation where inaccurate output could lead to harm, loss, injury, illness, poisoning, or liability

If you need certainty or expert judgment, consult a qualified local mycologist, poison center, medical professional, or other qualified expert.

If you suspect that any mushroom has been consumed and may be toxic, contact a poison center, physician, or emergency services immediately. Mushroom Identifier is not an emergency service and is not intended for urgent use.

9. Outputs

As between you and Mushroom Identifier, and to the extent permitted by applicable law, you may use the results returned by the service for lawful purposes.

However:

  • we do not guarantee that outputs are unique
  • similar or identical outputs may be generated for other users
  • we do not warrant that you will have exclusive rights in any output
  • your use of any output remains your responsibility

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain personal data in connection with Mushroom Identifier.

By using the service, you acknowledge that your personal data may be processed as described in the Privacy Policy.

11. Third-party providers and services

Mushroom Identifier relies on third-party providers to host, secure, analyze, and operate the service, including providers for storage, infrastructure, rate limiting, analytics, email, and AI/model inference.

We are not responsible for third-party services except as required by applicable law. Those providers may have their own terms, policies, and technical practices.

12. Availability, changes, and experimental nature

We may modify, suspend, restrict, or discontinue all or part of Mushroom Identifier at any time, with or without notice.

We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

Features may change over time. Some features, pages, or offerings may be marked as experimental, limited, or coming soon.

13. Fees and paid subscriptions

The core Mushroom Identifier identification service is free to use, subject to a daily usage allowance.

We also offer an optional paid subscription, Mushroom Identifier Unlimited, which lifts the daily allowance and unlocks additional features such as unlimited identifications, unlimited AI chat, and saved collections. The current plans, prices, and billing intervals are shown on our pricing and checkout pages.

Mushroom Identifier Unlimited is a recurring subscription billed in advance for the billing interval you choose (for example, monthly or yearly). Unless you cancel, it renews automatically at the end of each billing period, and the payment method on file is charged the then-current price for the next period.

Payments are processed by Creem, which acts as the merchant of record for your purchase. As merchant of record, Creem is the seller of record for the transaction and is responsible for billing, payment processing, and any applicable taxes. Your purchase is also subject to Creem's own terms and policies.

You can cancel at any time through the billing portal linked from your account. After you cancel, your paid access stays active until the end of the current billing period and does not renew after that. Except where required by applicable law, fees that have already been charged are non-refundable.

We may change our plans, prices, or features. If we change the price of a subscription, the new price applies to your next renewal after we provide any notice required by applicable law.

14. Intellectual property in the service

The Mushroom Identifier service, including its design, software, branding, text, graphics, interfaces, compilations, and other content made available by us, is owned by or licensed to us and is protected by applicable intellectual property and other laws.

Except for the limited right to use the service under these Terms, no rights are granted to you.

You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, sell, lease, sublicense, or exploit any part of the service except as permitted by law or with our prior written permission.

15. Feedback

If you send us suggestions, ideas, feedback, or recommendations about the service, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate that feedback for any lawful purpose without compensation or attribution to you.

16. Suspension and termination

We may suspend, block, restrict, or terminate your access to Mushroom Identifier at any time if we reasonably believe that:

  • you violated these Terms
  • your use creates risk, harm, legal exposure, or security issues
  • your use is abusive, excessive, fraudulent, or unlawful
  • suspension is needed to protect the service, users, third parties, or us

Because no account is required for the core identification service, suspension may include blocking access by technical means.

Sections that by their nature should survive termination or suspension will survive, including sections relating to ownership, disclaimers, liability, indemnity, governing law, and dispute resolution.

17. Disclaimers

To the maximum extent permitted by applicable law, Mushroom Identifier is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim, to the maximum extent permitted by law, all warranties including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment.

We do not warrant that:

  • the service will meet your requirements
  • the service will be uninterrupted, timely, secure, or error-free
  • results will be accurate, complete, reliable, or suitable for any purpose
  • defects will be corrected
  • the service or its infrastructure will be free from harmful components

Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

18. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, opportunity, goodwill, data, or use, arising out of or related to your use of or inability to use Mushroom Identifier, even if we were advised of the possibility of those damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the service or these Terms will not exceed the amount you paid us, if any, for the specific service giving rise to the claim in the 12 months before the event giving rise to liability.

These limitations apply regardless of the form of action and even if a limited remedy fails of its essential purpose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such liability cannot legally be limited.

19. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mushroom Identifier from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your User Content
  • your use or misuse of the service
  • your violation of these Terms
  • your violation of any law or third-party right

20. Changes to these Terms

We may update these Terms from time to time.

When we do, we will post the updated version on this page and update the last updated date above. Your continued use of Mushroom Identifier after updated Terms become effective means you agree to the revised Terms, to the extent permitted by applicable law.

If you do not agree to the updated Terms, you must stop using the service.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a business transfer, reorganization, sale of assets, or by operation of law.

These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding your use of Mushroom Identifier, unless and until additional terms apply to a specific feature or paid offering.
