1. Who We Are

2. Acceptance of These Terms

By accessing or using the App, you confirm that you have read and understood these Terms and the App’s safety warnings. If you do not agree to these Terms, do not use the App.

3. Eligibility

You may use the App only if you are legally permitted to do so where you live. If you are under the age required in your country to use digital services or to consent to the processing of your personal data, you may use the App only with the permission and involvement of a parent or legal guardian.

4. Important Safety Warning

The App is provided for informational and educational purposes only. Mushroom identification from photographs is inherently uncertain and may be inaccurate.

You must never use the App, on its own, to decide whether any mushroom is edible, non-toxic, safe to touch, handle, prepare, cook, or consume.

Before handling, preparing, or consuming any wild mushroom, you must obtain in-person confirmation from a qualified local mycologist or other competent expert.

If you suspect that any mushroom has been consumed and may be toxic, contact a poison centre, physician, or emergency services immediately. The App is not an emergency service and is not intended for urgent use.

5. Informational Service Only

The App provides image-based mushroom identification and related content for informational and educational purposes only. The App does not provide professional mycological, toxicological, medical, legal, or safety advice.

6. Your Content

You may submit content to the App, including photographs, notes, dates, and location information (“User Content”).

You represent that:

• you have the rights and permissions needed to submit your User Content;
• your User Content does not violate any law or the rights of any third party; and
• your User Content is not unlawful, malicious, or abusive.

You retain ownership of your User Content.

By submitting User Content, you grant Mushroom Identifier a limited, non-exclusive, worldwide licence to host, process, transmit, and display that User Content only as needed to operate, secure, maintain, and troubleshoot the App and to provide results requested by you.

We do not use your submitted User Content to train general-purpose AI models.

7. Privacy

Your use of the App is also subject to the Privacy Notice, which explains how we collect and use personal data, including photographs, notes, dates, and location information.

8. Acceptable Use

You must use the App only in a lawful and responsible manner.

You must not:

• use the App to make mushroom edibility or safety decisions contrary to the App’s warnings;
• use the App for any illegal, harmful, fraudulent, or abusive purpose;
• interfere with, disrupt, or attempt to gain unauthorised access to the App or its systems;
• scrape, copy, harvest, or extract data or outputs from the App on an automated basis except where permitted by law;
• reverse engineer, decompile, or attempt to discover the source code or underlying components of the App, except to the extent such restriction is prohibited by applicable law;
• upload malware, harmful code, or unlawful content; or
• misrepresent any result from the App as professional advice, guaranteed identification, or certification of safety.

9. Intellectual Property

Except for your User Content, the App and all related software, design, text, graphics, trademarks, and other materials are owned by or licensed to Mushroom Identifier and are protected by applicable intellectual property laws.

These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the App in accordance with these Terms. They do not transfer ownership of the App or any intellectual property rights to you.

10. Third-Party Services

The App may rely on third-party services such as hosting, analytics, mapping, geolocation, image-processing, or other technical providers.

Those third-party services may be subject to their own terms and privacy policies. Mushroom Identifier is not responsible for third-party services except to the extent required by applicable law.

11. Availability and Changes

We may update, modify, suspend, restrict, or discontinue all or part of the App at any time, including for maintenance, security, technical, legal, or operational reasons.

We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.

12. No Warranty of Accuracy

Mushroom Identifier does not warrant or guarantee that any identification, suggestion, description, ranking, confidence score, or other output generated by the App is accurate, complete, reliable, available, or fit for any particular purpose.

Outputs may be incorrect, incomplete, delayed, unavailable, or misleading.

13. User Responsibility

You remain solely responsible for all actions you take in reliance on the App, including any decision to collect, touch, handle, prepare, cook, or consume any mushroom or other wild organism.

You are responsible for evaluating whether any output is appropriate for your intended use and for obtaining human expert confirmation where safety is involved.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Mushroom Identifier excludes liability for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the App.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury to the extent such liability cannot lawfully be excluded or limited.

15. Consumer Rights

Nothing in these Terms affects any mandatory rights you may have under applicable consumer protection law.

16. Governing Law and Disputes

17. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the “Last updated” date above. By continuing to use the App after updated Terms take effect, you agree to the revised Terms.
